A question for the law talking guys

Does anyone besides me find it a little unsettling that the judge is taking so long to hand down a ruling on the SB 1070 injunction? It seems like if she was going to deny the injunction she would have had a decision on Friday or this morning. The fact that she hasn't released one makes me think she is really digging for precedent to justify the injunction.

Greg Sargent, allow me to introduce you to David Shuster

Greg Sargent of WaPo is convinced that only the right is capable of pushing information through the media, with a political agenda and without regard to factual integrity.

Right wing media are willing to engage in tactics that simply have no equivalent on the left -- even if mainstream news orgs and commentators keep taking refuge behind the notion that "both sides do it."

The leading lefty media organizations have teams of reporters who -- even if they are to some degree ideologically motivated -- work to determine whether their material is accurate, fair, and generally based in reality before sharing it with readers and viewers. They just don't push info -- with no regard to whether it's true or not -- for the sole purpose of having maximum political impact. Period.

Well, I can quickly call BS on this one.

Enter David Shuster, formerly of MSNBC, who in his attempt for glory in a "gotcha" moment with Rep. Marsha Blackburn (R-TN), stated falsely the location of a soldier who lost his life in the war. His efforts were clearly to have a political impact, by embarrassing a Republican elected official on national television. Shuster wanted a Republican to condemn the actions of a conservative talk show host. And in order to point to "hypocrisy", he demanded she name the last soldier from her district, who died in Iraq. Of course, he didn't fact check and was forced to issue an apology for being wrong about the name of the soldier and the district. He completely used the death of a young hero to achieve his goal. He cared not for the family of the young soldier or anyone else who might have been hurt in the process. Shuster used an innocent victim as a pawn for the sole purpose of political gain. Shuster wasn't a blogger or an activist. He was a cable television news reporter and anchor.

Ouch, that log in Sargent's eye must really be hurting by this time.

Sargent published his biased opinions full of tripe, without fact-checking to see if the mainstream media is guilty of the exact behavior he condemns. So I suggest Mr. Sargent take those rose-colored liberal glasses off and STFU from the cheap, pious seats. Period.

I see many phone brickings in the immediate future

Apparently the Library of Congress has seen fit to exempt rooting your phone from the DMCA.  I'm not convinced that this means that it's OK in the eyes of the cell provider to do this - Verizon, for example, has maintained that rooting your phone is a warranty violation, and I think the feds don't really have the legal standing to interfere in a service contract that two parties have agreed to.

So would someone with some legal background care to weigh in on this?

(And yes, I'm aware I've sold my soul for a shiny gadget.  Feel free to give me hell for it.)

Dear Newsweek: Please go bankrupt faster

Okay, so Newsweek's got they're "It's time to have a serious discussion on race," article here. 

Uh, how about we not have a serious discussion about race, we don't need one, other than discussing the fact that liberals and MSM operations like Newsweek can't help themselves but demagogue the right and call us racist over every opposing viewpoint we offer.   Not once in that entire article do they mention the fact that this was a retaliation against the NAACP for their move to slander Tea Partiers by declaring them all racist, or that Breitbart's focus was as much on the crowd cheering Sherrod declaring she was gonna screw some evil whitey farmer when he did that post.  They offer this bit of literary diarrhea as well,

Yes, it's all about facts, sorta like CBS using fucking Media Matters as their source to "debunk" concerns over the two club-wielding Black Panther fucktards at the Philly polling center.  But of course, CBS is a respectable news organization, not some partisan muckraker hack like that damnable Breitbart.  Spare me the self-righteous fucking bullshit about drawing conclusion from fact.

I'm tired of the fucking handwringers on our side on this issue, and I'm really superfuckingtired of the media's bullshit high and mighty act.  You fuckers in media pull this shit on us on a daily basis, then have the audacity to bitch when Breitbart (sorta) does it once?  Fuck you.  Fuck you with a rusty chainsaw, sideways.

Don't drink the water

That's an old cliche about traveling to foreign places, but it's a valuable tip—there are likely a bunch of bacteria and stuff in the local water that you're not used to, thus giving you the runny shits. But the locals drink the water all the time, and they're okay, seeing as how they're used to it, right?

New health and safety guidelines mean the water supply that has sustained the residents of Muck through the ages is no longer deemed safe to drink.

Officials have told the Hebridean island’s 35 inhabitants they must import mineral water from the mainland and are offering taxpayer-funded grants for a new treatment and purification system.

But angry residents complained no one has become ill after drinking water from the island’s eight natural springs, which are fed by rain clouds rolling across the Atlantic.

Lawrence MacEwen, whose family have owned the tiny isle since 1896, said: “All the houses on Muck are served by reliable springs of a quality at least as good as can be bought in bottles.

“But that is not good enough for our environmental health, who are insisting that all our water is treated before it reaches the houses.”

These people have been drinking the water unfiltered from the local springs for generations, but now they're being told by the government that they have to purify it, and they're going to get a £15,200 subsidy per household to purify water that has never made anybody sick.

God, I hope nobody in the O-ministration is reading this, looking for new ways to waste "stimulus" money.

I will be so glad when the primaries are over

I'm not sure which is worse - that Jane Norton tried to spin this in an email that Ken Buck said that he's sick of Tea Partiers, or that Ken Buck doesn't realize that the Tea Party is about as organized as Anonymous, and so it's about as useful to tell one of them to get control of their group as it is to herd cats.

On an audio tape obtained by The Denver Post, Buck was caught muttering "will you tell those dumba---s at the Tea Party to stop asking questions about birth certificates while I'm on the camera?" outside a June 11 event in Crowley.

This election cycle and the excuses made for some of the candidates have made me sick, and I've lost respect for some people (who shall remain nameless) that I really thought were moral and upstanding and believed in doing the right thing.

RIP Leslie, and Fuck Cancer

Our beloved co-blogger alexthechick has requested I let our three readers know that her BFF Leslie passed away this morning from Stage IV cancer.  She plans to make a post about this at another time, but right now she is exhausted.

My condolences, and I'm sure everyone else's here at DPUD, go out to you, alex.  It's been obvious for years that Leslie has been a rock in your life.  I know you'll miss her more than any of us can imagine.  I'm certain that I speak for all of us in telling you that if there is anything that any of us can do for you, please don't hesitate to ask.

You've probably heard about "The Ground Zero Mosque," an Islamic community center planned in Lower Manhattan. But I bet you haven't heard of The Ground Zero Strip Club.

There are actually a couple of adult entertainment venues that show up on Google Maps if you search around the former site of the World Trade Center. Internet reviewers seem to like New York Dolls best, due to its sexy, disproportionately Russian staff, mirrored stage and purportedly high-quality lap dances.

As yet, I haven't heard anyone wonder why our political class is silent as the sex industry operates on sacred ground.

NRSC to stay out of WV Sen primary - For realz this time (?)

Cornyn says they'll do candidate recruitment, then GTFO.

However, Cornyn indicated that once the candidate field is set, the NRSC is inclined to let West Virginia Republicans sort out the nomination for themselves. Cornyn also said the NRSC would decide how much money to commit to the fall special election and base the decision on how the contest between Manchin and the eventual GOP nominee develops.

"I haven't made any commitment to get involved in the primary," Cornyn said. "I think in this environment, it's best to let the primary voters do their thing and select the candidate. Because -- I think particularly in this environment -- folks are less interested in what people who work in Washington have to say."

I'm of mixed mind when it comes to party endorsements. In theory, the party could do some homework and weed out the nutter candidates. In practice however, it seems they chose unelectable dipshits more often than not, and give short shrift to legitimate candidates who could use help polishing their images. Cornyn's track record is particularly weak in this respect. His truth-telling track record about staying out of primary races is also pretty poor. So forgive me if I'm a bit skeptical of this pledge.

Daniel Schorr, NPR Senior Correspondent, Irresponsible Hack, Dead At Age 93

What more can be said except that he died without ever addressing my open letter. It’s not like he was unaware of it, besides the enormous audience (2 people) of my home blog I sent it to NPR.

I am sure he will be lionized by the journalistic community, but to me he was just a hack who was more interested in advancing his meme than telling the truth.
