1 I know it's not quite analogous, but I had to ask myself if they would have done the same thing if it was a kid instead of a dog.  Then I remembered when the kid down the street was mowed down by a truck in our residential neighborhood, the kid got the ticket.  He woke up in the hospital and found it lying on his chest (his parents hadn't even been notified of the accident yet).

But yeah, it's a jerk move on State Farm's part.

2 If the kid was on a bike, it easily could have been his fault.  Dog in the street means not on a leash, also makes it the owners fault.  Sure, it's a dick move, but if you start making exceptions then people will figure out how to abuse that.
