italy not full of retards

Berlusconi winsFor those confused about the title, Berlusconi stated that he didn't think anyone was retarded enough to vote for the lefty opposition this election, which caused a bit of a stir in the press.  He has a bit of a track record of saying things that give media types the vapors.  You've gotta love Berusconi, he just says whatever comes to mind.

I actually just got finished talking to some guys I know that work with an Italian construction firm here (I work in Nigeria) and when they heard about this I was given some interesting information about this Berusconi guy. I was told that he has ties to the mafioso and that his fortune was gained from some pretty shady deals, along with a slew of other negative things that they had to say about him. Almost an obligatory statement was the bitching about how close he was with Bush... so I decided to retort with the "didn't he win by a landslide vote?" -comment.

They agreed, and told me that no matter who or what this guy is, he is actually a source of stability for their governmental processes. Better the enemy you know I guess...

Actually I was told that the government has completely re-invented itself about 65 times since the Big II, so this guy's run is an extreme rarity. Eh, I just like to chuckle because the guy called his apponents "retards".

I'm like that.

Dear friends,

I am Italian and I am always surprised when I read certain comments on Berlusconi becuase it is evident that there is a strong lack of information or, I'd rather say, a lot of disinformation from people oppsing him.

First: In Italy, unfortunately, we have a very particular asset of the lawsuit system that sees the public prosecutor exactly in the same position of the judge.
In our country the public prosecutor cannot be fired (ever, they retire at 75), cannot be removed, is not responsible in any way of his decisions (in fact even civil lawsuits for injust detention are paid by th eCourt with public money), decides autonomously when and how to work (it's called "autocalendarizzazione", the only obligation is to hold at least one hearing morning a week...that's why trials last decades) and finally does not respond to any hierachic figure (there is nominally a "chief-prosecutor" but he cannot in any way interfere with the prosecutor's activities and proceedings so....
On top of this, as a cherry I suppose, their career is automatic as their wage advancements (there is a complex mechanism detrmined by the law), so their progress cannot in any way be stopped or slowed down by anyone.

Access to this "magic world" of power and intangibility whatsoever is granted by a public testing of candidates that have a bachlor in law and oviously, being our's a democratic country, there is no barrier nor question regarding one's poiltical thoughts.

Mr. Berlusconi, since his debut in politics in 1994, has been accused in 13 trials, all held by prosecutors with solid and well known left wing backgrounds and preferences, to the point that one of these - Francesco Saverio Borrelli - used to regularly attend and be photographed at political meetings and rallies of the Communist Refoundation Party or "PRC".

Before entering politics Mr. berlusconi had never been trialed.

Of these 13 proceedings none have reached a guilty verdict for Berlusconi that in fact in 9 of these has been stated "completely not involved in the facts" and "the facts did not sussist", in 3 of these he has been absolved for exceeding timelimit (the prosecutors after several years of inquiery and trial found nothing and the law at a certain point decleares the facts "not agnowledgeable without reasonable doubts") and in one, the famous SME trial, he was completely rendered "not guilty" and "the facts did not sussist" in 3 out of 4 accusations while in the fourth, tampering of official company balances, he was declared not guilty because of a law done by his government (from this episode comes the famous "he makes laws for his usage!!" hype).

Among the 9 trials in which he was descharged in 7 the dropping of the case was decided at the preliminary phases of inqiery (GIP, Judge for Preliminary Inqiery) because the accusations were clearly inconsistent.

One of these 7 is the famous, and totally dropped because inconsistent and evidently non credible (no evidence, no declarations, no suspects...nothing), "mafia" accusation...that was brought to court by a public prosecutor (guess what...left wing simpathizer and also writer on a left wing newspaper - il Manifesto) based on the fact that Antonio Mangano, a former employee of Berlusconi as gardner in one of his many villas, was trialed and found guilty of mafia cooperation.
Little detail: Mr Mangano was accused, and convicted, for facts occurred over 4 years after having been fired (as a gardner...) by Berlusconi.

Last but not least the accusation regarding his fortune build-up being unclear is due to the fact that Mr berlusconi's father, who died in the early '60ies, was an employee of a bank (Banca Rasini) who later collapsed in the '70ies and possibly had recicled some funds belonging to people tied to the mafia.
These fact are not supported by any proof whatsoever and the involvement of Banca Rasini with any criminal activity is, at state, a pure allegation.

I forgot to add:

4 of the 13 trials were instructed on accusations made by the prosecutors Mrs Boccasini and  Mr Colombo.

All 4 trials ended with a "not guilty" and "the facts did not sussist" (didn't occur) verdict by the judges.

Mrs Boccasini and Mr Colombo oviously, knowing our legal system, have not had any consequence whatsoever, have advanced in their career and are still public prosecutors.

What would happen in th eUK if a public prosecutor would bring to trial let's say Mr Tony Blair while in charge of the government or the opposition four times...and loose all the verdicts?
