First, there was never a flag@wthitehousel.gov, it's all some wingnut conspiracy.

Yeah, they're letting anybody blog here now. I mean, just because you have the same name as the blog doesn't mean anything.

So how does the FOIA work on the White House?
According to that Justice Dept link, it says:
FOIA applies only to federal agencies and does not create a right of access to records held by Congress, the courts, or by state or local government agencies. Each state has its own public access laws that should be consulted for access to state and local records.
Hmmmm, now who did they leave out? Federal agencies are under the President, as far as I know, they're all headed by a cabinet member and they all work for the President.
So is the White House a "federal agency" for FOIA purposes? They do not exclude them but they're very careful about telling you who's exempt.

Yes, under the Privacy Act and FOIA the White House is a federal agency. 5 USC sec. 552a, I believe.

Pursuant to the federal Freedom of Information Act, 5 U.S.C. ยง 552, I request access to and copies of all e-mails received by flag@whitehouse.gov and sent by the White House as a result of this e-mail address including e-mail addresses.
I would like to receive the information in electronic format.
Please waive any applicable fees. Release of the information is in the public interest because it will contribute significantly to public understanding of government operations and activities.
If my request is denied in whole or part, I ask that you justify all deletions by reference to specific exemptions of the act. I will also expect you to release all segregable portions of otherwise exempt material. I, of course, reserve the right to appeal your decision to withhold any information or to deny a waiver of fees.
I look forward to your reply within 20 business days, as the statute requires.
