Microsoft is swinging the banhammer on close to one million, yes, million XBox Live users for modifying their console or using pirated software, both violations of XBox Live terms of use.  I'll be curious where these people go, if Sony will turn a blind eye to piracy and mods in order to exploit Microsoft cracking down on piracy.  I'm leaning toward no, because the games are where they all make their money, people that use pirated software are only going to bring so much profit.
