Legalized spousal rape
WTF kind of country is it where the men are universally so undesirable that it has to be legislated that wives have to put out twice a week?
"As long as the husband is not traveling, he has the right to have sexual intercourse with his wife every fourth night," Article 132 of the law says. "Unless the wife is ill or has any kind of illness that intercourse could aggravate, the wife is bound to give a positive response to the sexual desires of her husband."There's a strange sort of incongruity that Hillary Clinton is being called upon to put pressure on the Afghanistani president to repeal this law. She did such a wonderful job with an American president's sexual harassment, I'm sure she can channel that experience into her dealings with Hamid Karzai.

Are we totally sure that the effect of this is to legalize rape, and not just to get more specific about some details about what would constitute breach of contract or grounds for divorce or something? Because this kind of reminds me of the kind of thing that a certain sordid breed of blogger is prone to say amounts to legal rape in the US.

It doesn't say "If the wife isn't spreading her legs every fourth night, the husband can divorce her", it says "he has the right to have sexual intercourse with his wife every fourth night" and "the wife is bound to give a positive response to the sexual desires of her husband". Some accounts of the law have also stated that the husband's required to put out every four months.
I can't tell you the penalties for violating the law - the Afghan government has refused to provide a copy of the law to any outside organization that has asked for it. So it's possible that the penalty is a dime for every transgression, or a good home-cooked meal. The law (which only applies to Shiite Muslims) is under review now - enough Sunni female MPs pitched a fit about the violation of equal rights that it's being reviewed for constitutionality.
I think there's a difference between "This is what you should do if you want to have a happy marriage" and the codification of "This is what you will do to have a happy marriage".

More than that, even if the penalties attached to the law are small, it still establishes a repugnant norm--that wives will put out on demand, free will be damned. Even if it were construed as a statement of mere principles, it should be condemned.

I remember an article about an Australian Judge who ordered a man, a shepard if I recall correctly, to have sex with his wife at least three times a week or some such thing. The reasoning was that marrage implies a sexual relationship to exist.

Was the fact that he was a shepherd relevant? Or should I ask, was the fact that he was around sheep all day relevant to the issue of him not having marital relations with his wife?
